General
The following are the rules or "Terms" that govern use of the In Demand Tickets Web site ("Site"). By using or visiting the Site, you expressly agree to be bound by these Terms and to follow these Terms and all applicable laws and regulations governing the Site. In Demand Tickets reserves the right to change these Terms at any time, effective immediately upon posting on the Site.

Since our online ordering system is not in "real time", occasionally tickets ordered online may no longer be available. If equivalent or better seat locations are available at the same price, and you have chosen to be automatically upgraded, we will fill your order with the alternative seat locations. If you are automatically upgraded, your credit card will be charged at the time your order is confirmed and you will be contacted for notification of your new seat locations. If you have not chosen to be automatically upgraded, an In Demand Tickets representative will contact you to discuss alternative seat locations, and your credit card will not be charged until we have received permission from you to fill your order with alternative seat locations. In the rare event that we cannot fill your order with equivalent or better seats at the same price, an In Demand Tickets representative will contact you and your credit card will not be charged.

Once an order has been confirmed, a sales agent will contact you via email, fax or phone. NOTE: Customers ordering online will receive an immediate email receipt confirming your request for tickets. An official confirmation of a completed order will be clearly indicated via email, phone, or fax by a sales agent AFTER your order has been processed in our office. In Demand Tickets is not responsible for email confirmations not received (i.e., spam filters). If you have not received an email confirmation within 2 business days (Mon-Fri) after placing your order, please contact our office.

Orders placed after 5 PM Central Time weekdays, on holidays, or on weekends may not be processed until the next business day.

Unfortunately, we are not able to accept any orders from outside the USA and Canada. There will be NO exception to this policy. The credit card used to purchase tickets must have a US or Canadian billing address and we MUST ship the tickets to the credit card billing address.

If a customer feels that there is any discrepency between the tickets that they receive and the tickets that they ordered, they must contact our office within 48 hours of the receipt of the tickets and we will investigate promptly. Failure to contact our office within 48 hours after receipt of the tickets implies acceptance of the tickets delivered and no refunds and/or exchanges will be given after this time period, except for cancelled events.

Payment Methods
In Demand Tickets accepts the following methods of payment: American Express, MasterCard, Visa, and Discover.

All listed ticket prices are in U.S. dollars. We accept only American currency and cannot accept credit cards with a billing address outside of the United States or Canada.

All orders that are to be shipped to an address other than the credit card billing address require a Credit Card Authorization Form to be filled out by the credit card holder and faxed back to us along with a copy of the credit card (front and back) and driver's license. In Demand Tickets reserves the right to request a Credit Card Authorization Form at its discretion.

All customer information is strictly confidential and used only to verify the customer's identity and prevent fraudulent activity. Authorization Forms must be returned to us in a timely manner. We reserve the right to cancel an order if the proper documentation has not been returned to us even if the order has been confirmed. Please follow instructions carefully.

Pricing and Availability
In Demand Tickets is a private ticket agency and is not affiliated with any venue, box office, franchise, TicketMaster, Tickets.com, or any of their respective affiliates. In Demand Tickets is a reseller of tickets, and frequently pays more than the original face value to obtain tickets that are in high demand. The amount you pay above face value reflects the cost of obtaining premium tickets. We obtain tickets via a variety of methods, including from season ticket holders and from individuals with extra tickets to an event.

Tickets are bought and sold on an open market. Prices and availability are subject to change at any time before an order is confirmed.

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, In Demand Tickets shall have the right to refuse or cancel any orders placed for product listed at the incorrect price.

Orders received with invalid credit cards, declined credit cards, or credit cards that don't match the billing address will not be reserved. We reserve the right to cancel an order and give a full refund at any time, for any reason whatsoever.

Lost, Stolen, or Damaged Tickets
Once your tickets are received, they should be treated just like cash. If the tickets are lost, stolen, damaged, or destroyed in any way there is no way to get replacement tickets. NO refunds, exchanges, replacements, or credits will be given for tickets that are lost, stolen, damaged, or destroyed once received by the customer.

Refunds and Exchanges
All sales are final. Since tickets are a one-of-a-kind item and not replaceable, there are no refunds, exchanges or cancellations. If an event is postponed, tickets will be honored for the rescheduled date. New tickets will not need to be issued. If an event is cancelled without a rescheduled date, customer will receive a full refund for the amount paid for the tickets, provided the tickets are returned to our office within 30 days of the original event date. Any shipping and handling charges are not refundable. In Demand Tickets will not issue exchanges or refunds after a purchase has been made or for lost, stolen, damaged or destroyed tickets. When you receive your tickets, please keep them in a safe place. Please note that direct sunlight or heat can sometimes damage tickets.

Shipping
FedEx is used for all shipments and a signature is required upon delivery for every order. FedEx will NOT deliver to a P.O. BOX, so you must provide us with a physical street address.

We do not allow any reroutes on the package. The courier must deliver it to the address on the package. If you have any specific delivery requirements, please make those arrangements via telephone when you place the order.

Tickets must be sent to your credit card billing address, which will be verified with your credit card company.

Should you require that the order be shipped to an alternate address, we will require faxed authorization from you. This includes a signed copy of a form we will send to you along with legible copies of your driver's license and the front and back of the credit card that was used. This is done to protect both of us against fraudulent use.

If you do not receive your tickets at least 2 days prior to the event, you must call or email our office so we can track your shipment. In Demand Tickets is not responsible for late deliveries if you do not call us at least 2 days prior to the event to advise us that you have not received your tickets.

Upon delivery of tickets, you must review all documents for accuracy. Call us immediately if there is any discrepancy. In Demand Tickets will not be responsible for any discrepancies if you do not contact us within 48 hours after receiving your tickets.

Permitted Use
You agree that you are only authorized to visit, view, and to retain a copy of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review event and promotional information, for personal use, or to purchase tickets or merchandise for your personal use, unless otherwise specifically authorized by In Demand Tickets to do so. The content and software on this Site is the property of In Demand Tickets and/or its suppliers and is protected by U.S. and international copyright laws.

Links
The Site may automatically produce search results that reference or link to third party sites throughout the World Wide Web. In Demand Tickets has no control over these sites or the content within them. In Demand Tickets cannot guarantee, represent or warrant that the content contained in the sites is accurate, legal and/or inoffensive. In Demand Tickets does not endorse the content of any third party site, nor do we warrant that they will not contain viruses or otherwise impact your computer. By using the Site to search for or link to another site, you agree and understand that you may not make any claim against In Demand Tickets for any damages or losses, whatsoever, resulting from your use of the Site to obtain search results or to link to another site. If you have a problem with a link from the Site, please notify us at scott@indemandtix.com and we will investigate your claim and take any actions we deem appropriate at our sole discretion.

Prohibited Content
The following is a partial list of the kind of Content that is illegal or prohibited on the Site. It includes Content that:

• Is patently offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual.
• Could be harmful to minors.
• Harasses or advocates harassment of another person; Involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming".
• Promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous.
• Promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files.
• Contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page).
• Displays pornographic or sexually explicit material of any kind.
• Provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18.
• Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses.
• Solicits passwords or personal identifying information for commercial or unlawful purposes from other users.
• Engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

Violation of the Terms
You understand and agree that in the sole discretion of In Demand Tickets, and without prior notice, In Demand Tickets may terminate your access to the Site, cancel your ticket order, or exercise any other remedy available and remove any unauthorized User Content, if In Demand Tickets believes that the User Content you provided has violated or is inconsistent with these Terms of Use that violated the rights of In Demand Tickets, another User, or the law. You agree that monetary damages may not provide a sufficient remedy to In Demand Tickets for violations of these terms and conditions and you consent to injunctive or other equitable relief for such violations. In Demand Tickets may release user information about you, if required by law or subpoena, or if the information is necessary or appropriate to release to address an unlawful or harmful activity. In Demand Tickets is not required to provide any refund to you if you are terminated as a User because you have violated these Terms of Use.

Copyright Policy
We will terminate the privileges of any user who uses this Site to unlawfully transmit copyrighted material without a license express consent, valid defense or fair use exemption to do so. In particular, users who submit Content to this Site, whether articles, images, stories, software or other copyrightable material must ensure that the Content they upload does not infringe the copyrights or other rights of third parties (such as privacy or publicity rights). After proper notification by the copyright holder or its agent to us, and confirmation through court order or admission by the user that they have used this Site as an instrument of unlawful infringement, we will terminate the infringing users' rights to use and/or access to this Site. We may, also in our sole discretion, decide to terminate a user's rights to use or access to the Site prior to that time if we believe that the alleged infringement has occurred.

Disclaimers
In Demand Tickets does not promise that the Site will be error-free, uninterrupted, nor that it will provide specific results from use of the Site or any Content, search or link on it. The Site and its Content are delivered on an "as-is" and "as-available" basis. In Demand Tickets cannot ensure that files you download from the Site will be free of viruses or contamination or destructive features. In Demand Tickets disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose. In Demand Tickets will not be liable for any damages of any kind arising from the use of this Site, including without limitation, direct, indirect, incidental, punitive and consequential damages.

In Demand Tickets makes no guarantee of any specific result from use of this Site or use of the In Demand Tickets service.

In Demand Tickets disclaims any and all liability for the acts, omissions and conduct of any third party users, In Demand Tickets users, advertisers and/or sponsors on the Site, in connection with the In Demand Tickets service or otherwise related to your use of the Site and/or the In Demand Tickets service. In Demand Tickets is not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with or referenced on the Site. In Demand Tickets may investigate the claim and take appropriate action, in its sole discretion.

Limitation on Liability
Except in jurisdictions where such provisions are restricted, in no event will In Demand Tickets be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits, even if In Demand Tickets has been advised of the possibility of such damages.

Disputes
If there is any dispute about or involving the Site, by using the Site, you agree that the dispute will be governed by the laws of the State of Texas without regard to its conflict of law provisions. You agree to personal jurisdiction by venue in the state and federal courts of the State of Texas, City of Richmond.

Indemnity
You agree to indemnify and hold In Demand Tickets, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site.
